1. About these terms
These terms are an agreement between you and INFOXERA FZE, a company registered in the Sharjah Research, Technology and Innovation Park (SRTIP), Sharjah, United Arab Emirates, which runs CartGains (“we”, “us”, “our”). They cover the Sticky Bundles & Quantity Breaks Shopify app (“the app”) and this website.
By installing or using the app, you agree to these terms. If you are installing the app for a business, you confirm that you have the authority to agree to these terms on its behalf.
2. The app
The app shows quantity discounts and product bundles in a bar at the bottom of your store’s product pages. It builds bundles from the products each shopper views during their visit, based on the discount rules you set.
To use the app you need an active Shopify store. Your use of Shopify is also covered by Shopify’s own terms, and some parts of the app depend on Shopify’s systems working as expected.
3. Your responsibilities
When you use the app, you agree to:
- give accurate information and keep your Shopify account secure;
- set up your discounts and offers carefully, and check them before they go live;
- honour the offers and prices shown to shoppers in your store;
- follow the laws that apply to your store, including consumer protection, pricing and privacy laws; and
- make sure your store’s privacy policy tells shoppers about the apps you use.
4. Discounts and orders
The app applies discounts through Shopify’s own discount system at checkout, following the settings you choose. You decide the discount amounts, the maximum discount and which collections are included.
You are responsible for the offers you create and the prices your shoppers pay. We are not responsible for losses caused by discount settings that you set up or approved, or for issues caused by Shopify, your theme or other apps installed in your store.
5. Fees
The app’s current plans and prices are shown on its Shopify App Store listing and inside the app. Any charges are billed by Shopify, through your regular Shopify invoice, and are subject to Shopify’s billing terms.
If we introduce or change charges, we will tell you in advance, and you can choose to uninstall the app before any new charge applies.
6. Cancelling and refunds
You can cancel at any time by uninstalling the app from your Shopify admin, and you won’t be charged again. Because Shopify handles billing, we don’t automatically refund part of a month when you cancel. If something has gone wrong, email us at hey@cartgains.com and we’ll arrange a refund through Shopify where we can. Every plan starts free, so you never pay before the app has already paid for itself.
7. Acceptable use
You agree not to:
- copy, modify, resell or reverse engineer the app;
- use the app to break any law or to mislead shoppers;
- try to access data that does not belong to your store, or interfere with how the app works for others; or
- use the app in a way that could harm us, Shopify or other merchants.
8. Ownership
We own the app, this website and everything in them, including their design, code and content. Using the app gives you a limited, non-exclusive right to use it for your store while it is installed.
You keep ownership of your store, your products and your data. You allow us to use your data only as needed to provide the app, as described in our Privacy Policy.
9. Availability and changes
We work hard to keep the app running smoothly, but we cannot promise it will always be available or free of errors. We may improve, change or remove features over time, and we will try to give notice of any change that significantly affects you.
10. Results and warranties
The app is designed to help you increase your average order value, but results depend on your store, your products and your shoppers, and we do not guarantee any particular increase in sales or revenue.
To the extent the law allows, the app is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
11. Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for any loss of profits, revenue, data or business, arising from your use of the app.
Our total liability to you for any claim related to the app is limited to the amount you paid us for the app in the 12 months before the claim, or USD 100 if you have not paid us anything.
12. Indemnity
You agree to cover any claims, losses or costs we face because of how you use the app in your store, including the offers you create or a breach of these terms by you.
13. Ending your use of the app
You can stop using the app at any time by uninstalling it from your Shopify admin. We may suspend or end your access if you break these terms or if we stop offering the app, and we will give notice where we reasonably can.
After you uninstall the app, your data is handled as described in our Privacy Policy.
14. Governing law
These terms are governed by the laws of the Emirate of Sharjah and the federal laws of the United Arab Emirates. Any dispute will be handled by the courts of Sharjah, unless the law where you are based gives you the right to bring a claim elsewhere.
15. Changes to these terms
We may update these terms from time to time. We will change the “Last updated” date at the top of this page, and if the changes are significant we will let you know by email or inside the app. If you keep using the app after the changes take effect, you accept the updated terms.
